Hylton Remembers: While The Mich Cows Remain Productive and The Beatings are Unabated

 Around 1970, when I was but a wee boy, of nineteen, Nikita Khrushchev published a memoir: Khrushchev Remembers.

I liked the sound of the title and emulate it often.


Hylton remembers that POST, the sister Agency of the CA-DOJ, the one that launched the investigation that brought about Montana’s investigation of Hylton, including the interception of his mail, was an award-winner too.  Yes, on recollection, the YouTube video and perhaps RIPA documents and including items on YouTube, claim, rather trumpet, that POST’s video productions, a central part of its now, much reviled curriculum, was an award winner too.  The following is what the California Department of Justice has to say about its ward, or its ward's the award-winning spawn or relative:

 

After the DPA’s award-winning 2020 audit of SFPD’s use of force policy, SFPD implemented about half of DPA’s recommendations by June 2022. The DPA is increasingly closing cases based on evidence, rather than claiming the evidence insufficient.808 The DPA is also progressively resolving cases in a timely manner before the statutes of limitations run. The DPA is not without its critics. Some police reform activists believe DPA is not equipped with sufficient tools to effect change in SFPD, despite being able to make discipline and policy recommendations and being well-funded. Critics point to the SFPD Chief’s refusal to impose any discipline in twenty-five percent of cases for which DPA recommended discipline.811 However, the Chief agreed with the DPA’s recommended discipline in forty-one percent of cases and actually imposed more discipline than DPA recommended in thirteen percent of cases.812 Another concern is the inability of DPA to require the SFPD to make urgent reforms.813 DPA officials also noted that they can issue reform suggestions, but cannot enforce discipline measures until new policies are updated, which allows officer misconduct to continue in the meantime.

 

My experiences with the SF DPA differ. Not only were they slow with the intake of my complaint(s), but they also misstated the contents and nature of it, in violation of law. As you know, or should, the law requires that upon entry or acceptance of a complaint, an acknowledgement, in the complainant's own words, be provided.

 The essence of my complaint was and remains that:

  1. Asians were being milked, for Citation revenue and;
  2. Further reductions in stops, which reductions were based on a hope that such reductions may bring about a diminution of disparities, had already been tried and had not worked but have failed spectacularly.



I do know that, after I complained to the CA-DOJ/RIPA Advisory Board, of SF DPA’s sloth, which complaint was, to a large extent, based on my misapprehension of the legal deadline that governs the issuance of "findings.", a report of findings was issued and sent to me. I did not read it, for SF DPA had not followed the law (misstating my complaint, not using my words); had not promptly handled the intake of the complaint; had not followed its own procedures in providing regular status updates.

I do note that the massive reductions in SFPD stops are duly noted in the 2023 RIPA Report, but without meaningful comment. Let me repeat one that I have made often, San Francisco’s Use-of-force disparities trend upwards, despite the award(s) won. Tell them to talk to POST about awards.

In the aforementioned complaint, I asserted that San Diego should stop fewer people, and that San Francisco could not possibly stop fewer. See the San Francisco's article on "What are exactly are they doing? SF Traffic cops issue just 10 citations"



I can happily claim that both LEAs and/or those who administer their affairs, have been obedient since the time of my writings. San Diego is stopping far fewer people, almost half the number they used to, and The DPA has not embraced, or has put on "hold", the already disproven madness that was at the heart of my complaint; a further ridiculous stop reduction where they had already reduced stops by almost 75%. Moreover, Boudin has already been driven out of Office.

 I would like to say “All’s well that ends well” but we are nowhere near the end of anything. Black people, especially, continued to be beaten up, but if the data numbers are correct, fewer of them. But if these smaller numbers are compared to their Whitecounterparts, it is indisputable that things are getting worse.

 No wonder the reduced stop numbers have no meaningful comments; something curious; something strange, since the plaudits to the SF DPA have everything to do with awards won for things connected to Use-Of-Force; the Black Disparity for which stands at 10. As I recall, last year it was quite a bit lower.

Berkeley; the bastion of progressive values?

April 26, 2018 Yesterday, I sent the within to the Mayor of Berkeley and others, in the mayor's office, as listed. Much nothing will come of it; not until Berkeley is sued for some  atrocity in policing. Believe me, it is just a matter of time. Doubtless we will have the usual protestations, denials and promises. The lot below shall not be able to say that they did not know of the rot; the oppression; the bias. Berkeley's data is, for want of a polite expression, piss-poor. This opinion may be partly driven by the fact that the data is not in the form that Berkeley represents it to be; that over 3,400 records have no demographic data, and that it leaves out some of the most basic, the most common, policing data elements. On the other hand, it carries data of other persons involved in the stop, but one cannot determine who is driver and who is passenger.
